Are Terms of Service legally binding?οΌ
They are enforceable when the user has clear notice and takes an affirmative action to accept, such as ticking a box or clicking 'I agree'. Terms hidden in a footer link with no acknowledgement are far harder to enforce.
What is the difference between Terms of Service and a Privacy Policy?οΌ
Terms of Service govern the rules for using your product and the commercial and legal relationship with the user. A Privacy Policy specifically discloses how you collect, use, and share personal data, and is often legally mandated separately.
Can I change my Terms of Service after users have agreed?οΌ
Yes, if you include an amendment clause and give reasonable notice of material changes, typically by email or in-app notice. Continued use after the effective date usually constitutes acceptance of the updated terms.
